NOTIFICATION

WHEREAS, the Government of Kerala are satisfied that public
interest so requires that the industry, namely “All Export
Oriented Units and all other units incidental thereto in the
Cochin Special Economic Zone”, which is an industry specified in
the First Schedule to the Industrial Disputes Act, 1947 (Central
Act 14 of 1947), shall be declared to be a Public Utility Service
for the purposes of the said Act.
Now, THEREFORE, in exercise of the powers conferred
by sub-clause (vi) of clause (n) of section 2 of the Industrial
Disputes Act, 1947 (Central Act 14 of 1947), the Government of
Kerala hereby declare the said industry to be a Public Utility
Service for the purpose of the said Act, for a further period of
six months from 3rd January, 2006, subject to the
condition that no legal rights of the workers shall be denied
during the said period.

Explanatory Note
(This does not form part of the Notification, but
is intended to indicate its general purport.)
Government of Kerala have declared the Industry, “All Export
Oriented Units and all other units incidental thereto in the
Cochin Special Economic Zone” as a public utility service under
the Industrial Disputes Act, 1947 (Central Act 14 of 1947) as per
Notification issued under G.O. (Rt.) No.956/85/LBR dated 13th
June, 1985. The validity of the said notification has been
further extended from time to time by similar notifications. The
last notification was issued as per G.O. (Rt.). No.1767/2005/LBR,
dated
29th June, 2005
and published as S.R.O. No.659/2005
in the Kerala Gazette Extraordinary No.1462
dated
30th June, 2006
and validity of the said notification will expire on
2nd January, 2006.
The Government have satisfied that public interest so requires to
declare the said industry to be a Public Utility Service and
therefore decided to declare the said industry to be a Public
Utility Service for a further period of six months with effect
from 3rd
January,
2006.
This notification is intended to achieve the above
object.
